第三十二条 行政执法监督机构在履行监督职责过程中，发现行政执法人员存在违法或者明显不当情形的，综合考虑主客观原因、后果、纠正情况等因素，提出对其作出批评教育、离岗教育、调离执法岗位、取消执法资格等处理的建议，由有权机关依法处理。
